1.Acceptance of Terms

TalentCursor is a brand owned and operated by Hirefliq Tech Solutions Pvt. Ltd. ("TalentCursor," "we," "us," or "our"), a company incorporated in India with its registered office at 401, Plot 157, Surya Towers, Kakateeya Hills, Madhapur, Hyderabad, Telangana – 500081. By accessing this website, submitting your profile, or engaging our services in any capacity, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

2.Description of Services

TalentCursor is a recruiting and talent search firm. We offer:

• Sprint Hire — structured, sourcing-at-scale search for active hiring mandates
• Executive Search — retained or embedded search for leadership and senior roles
• Remote Hire — sourcing and placement of India-based engineering, AI, and product talent for distributed teams, on a source-and-place basis (see Section 6)

TalentCursor is a recruiting services provider. We are not an employment agency that itself employs Candidates, and we do not guarantee that any Candidate will be shortlisted, interviewed, offered a role, or hired.

3.Eligibility

Our services are intended for individuals and organizations with the legal capacity to enter into binding agreements. By using our services, Candidates represent that they are at least 18 years of age and legally eligible to work, and Clients represent that the individual engaging with us has the authority to act on behalf of their organization.

4.Terms for Candidates

• Accuracy of information. You agree that any information you provide to us — including your resume, work history, and any representations made during screening — is accurate and not misleading. We rely on this information when presenting you to Clients, and inaccurate information may result in your removal from consideration.
• No fee, ever. TalentCursor does not charge Candidates any fee, at any stage, for inclusion in our search process, evaluation, or presentation to a Client. If anyone claiming to represent TalentCursor asks you for payment, please report it to us immediately using the contact details in Section 17.
• AI-assisted evaluation. Your profile may be sourced, parsed, and scored by the TalentCursor Engine as part of our process. This is governed in detail by Section 6 of our Privacy Policy, including your right to request human review and to withdraw consent. Every recommendation made to a Client is reviewed and decided upon by a human search specialist.
• No guarantee of outcome. Being sourced, screened, or shortlisted by TalentCursor does not guarantee an interview, offer, or placement. Hiring decisions are made solely by our Clients.
• No employment relationship with TalentCursor. Engaging with TalentCursor as a Candidate does not create an employment, agency, or contractor relationship between you and TalentCursor, or between you and Hirefliq Tech Solutions Pvt. Ltd.
• Confidentiality. Information you receive about a specific role or Client during our process is shared in confidence and should not be disclosed to third parties without our consent.

5.Terms for Clients

• Governing agreement. These Terms describe the general basis on which we operate our website and services. The specific scope, fees, deliverables, and commercial terms of any engagement are set out in a separate signed agreement or statement of work between TalentCursor and the Client, which will govern in the event of any conflict with these Terms.
• No guarantee of hire. While we apply our full search and evaluation process to every mandate, we do not guarantee that any engagement will result in a successful hire. Any replacement, guarantee, or refund terms are governed exclusively by the specific engagement agreement, not by these Terms.
• Confidentiality of candidate data. Clients agree to use candidate information shared by TalentCursor solely for the purpose of evaluating that candidate for the relevant mandate, and not to share it further without the candidate's or TalentCursor's consent.
• Non-circumvention. Clients agree not to engage, directly or indirectly, with a Candidate presented by TalentCursor outside the terms of the applicable engagement agreement, where doing so would circumvent fees properly owed to TalentCursor.

6.Additional Terms for Remote Hire

Specifically, for any engagement, employment, or contracting relationship arising from a Remote Hire introduction:

• The Client contracts with, and pays, the Candidate directly. TalentCursor is not an employer of record, payroll provider, or intermediary to that relationship.
• TalentCursor is not responsible for, and makes no representation regarding, statutory compliance, taxation, benefits, performance management, or termination of that relationship. These are matters between the Client and the Candidate, governed by the laws applicable to their direct relationship.
• Clients engaging in cross-border hiring through Remote Hire are responsible for ensuring their own compliance with applicable employment, tax, and immigration laws in the Candidate's and their own jurisdiction.

7.Intellectual Property

All content on this website — including text, design, the TalentCursor name and logo, the TalentCursor Engine, and our evaluation methodology — is the property of Hirefliq Tech Solutions Pvt. Ltd. or its licensors, and is protected by applicable intellectual property laws. You may not copy, reproduce, or use this content for any commercial purpose without our prior written consent.

8.Acceptable Use

You agree not to:

• Submit false, misleading, or fraudulent information to us
• Use automated means to scrape, copy, or extract data from this website
• Misuse our contact form, including for spam or unsolicited commercial messages
• Impersonate any person or misrepresent your affiliation with any organization
• Attempt to interfere with or compromise the security of this website

9.Third-Party Links & Services

Our website and process may reference or link to third-party platforms, including LinkedIn, Naukri, GitHub, and our form-processing provider. We are not responsible for the content, privacy practices, or terms of these third-party services, and your use of them is governed by their own terms.

10.Disclaimer of Warranties

This website and our services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of uninterrupted or error-free operation. We do not warrant or guarantee any specific hiring, career, or business outcome.

11.Limitation of Liability

To the maximum extent permitted by law, Hirefliq Tech Solutions Pvt. Ltd. and TalentCursor shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this website or our services, including loss of profits, business opportunity, or data. Our total aggregate liability arising from any engagement shall not exceed the fees actually paid to us by the relevant Client in connection with that engagement, except where such limitation is not permitted by applicable law.

12.Indemnification

You agree to indemnify and hold harmless Hirefliq Tech Solutions Pvt. Ltd. and TalentCursor from any claims, damages, or expenses arising from your breach of these Terms, your misuse of this website, or any information you provide to us that you knew or should have known to be inaccurate.

13.Confidentiality

Both Candidates and Clients agree to treat non-public information shared through our process — including role details, candidate evaluations, and business information — as confidential, and to use it solely for the purpose for which it was shared.

14.Termination

We reserve the right, at our discretion, to decline to take on a mandate, to discontinue an engagement, or to remove any Candidate or Client from our active process, with or without notice, where we believe it is appropriate to do so.

15.Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably. Failing amicable resolution, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement of the parties. The seat and venue of arbitration shall be Hyderabad, Telangana, and the proceedings shall be conducted in English. Subject to the foregoing, the courts at Hyderabad, Telangana shall have exclusive jurisdiction over any matter not subject to arbitration, including applications for interim relief.

16.General Provisions

• Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Entire agreement. These Terms, together with our Privacy Policy and any signed engagement agreement, constitute the entire agreement between you and TalentCursor regarding your use of our website and services.
• Changes to these Terms. We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our website or services after changes take effect constitutes acceptance of the revised Terms.
• No waiver. Our failure to enforce any provision of these Terms shall not be construed as a waiver of that provision.
